For Form I-864, domicile generally means the sponsor’s principal residence with an intention to maintain it for the foreseeable future. A U.S. passport, mailing address, or joint sponsor does not automatically establish the petitioning sponsor’s domicile. The evidence should show the real residence or a credible qualifying plan to establish it. [1]
Rules that determine the answer
State Department guidance recognizes maintaining U.S. domicile during a temporary stay abroad, certain qualifying employment abroad, or concrete steps to establish domicile no later than the immigrant’s admission. A joint sponsor can address an income shortfall but cannot replace the petitioner’s own required age, citizenship or residence status, and domicile qualifications. [2]
Useful records depend on the claimed facts: leases or property records, tax filings, bank activity, employment documents, school registration, and evidence that overseas residence is temporary can each contribute. No single item is a universal checklist substitute. [1] Lawful voter registration may be relevant for a citizen but should never be suggested to a person who is not eligible to vote. If the petitioner will not precede the immigrant, the plan must support arrival together by the required time, rather than an indefinite later move.
What to do next
- Identify which domicile route applies and give a consistent explanation of the residence history.
- For maintained domicile, provide records showing the continuing U.S. principal home and temporary nature of the absence.
- For reestablishment, document concrete steps such as a residence, employment search or offer, transferred funds, and children’s school arrangements.
- Submit the evidence as instructed by NVC and carry any needed updated material to the visa interview.
Practical example
A sponsor living abroad signs a U.S. lease, arranges employment, moves funds, and plans to enter with the immigrating spouse. Those coordinated steps are more persuasive than a single unused bank account and a statement that the family might move someday.
