An F-1 student can pursue OPT while an employer pursues H-1B classification. The filings serve different purposes: OPT authorizes qualifying practical training under F-1 rules, while H-1B requires the employer’s petition and any necessary change of status or admission. [1]
Registration is not a petition or work permit
Selection in a cap registration process only permits the selected employer to submit an eligible cap petition. It does not itself authorize employment, extend an EAD, or approve H-1B status.
Check cap-gap requirements
The F-1 rules provide a cap-gap mechanism for qualifying cases involving a timely H-1B petition requesting change of status. Whether it extends status only or also employment depends on the student’s circumstances and authorization when the relevant filing occurs. Do not assume that every OPT applicant receives it. [1]
Continue complying with OPT
While working under OPT, employment must satisfy OPT rules, reporting must remain current, and unemployment limits continue to matter. The proposed H-1B employer also has independent wage obligations under the labor-condition rules. [2]
For example, an employer’s registration selection does not permit a student whose OPT has ended to keep working without a valid extension or other authorization.
Coordinate with the designated school official and employer before travel, a job change, or a gap in authorization. Keep both filings and approval dates distinct.
Account for the September 2026 status transition
Current section 214.1(m) transitions qualifying legacy F/J duration-of-status admissions to fixed periods; it does not simply end every prior D/S admission on September 15. For covered F-1 students, specified timely OPT or STEM OPT applications filed on or before March 18,2027 have an exception to an otherwise required separate I-539, subject to the detailed transition conditions. Travel and readmission can change which provision applies. Have the DSO and counsel review the actual I-94, I-20, EAD, filing date, and travel history rather than assuming every OPT request follows the same extension procedure. [3]
Resolve a gap before performing work
Have the employer and DSO identify the precise authority covering every proposed work date. An H-1B filing receipt, school recommendation, and unexpired OPT EAD each answer different questions. An unresolved gap should not be filled by assuming selection alone extends employment. Keep the filing and effective dates together with the status-transition review. [1] [3]
See late OPT employment reporting and H-1B worksite amendments for common issues after the initial filing.
