An absence caused by a work injury can count simultaneously as workers’ compensation leave and FMLA leave when the employee, employer, and medical condition meet the FMLA requirements. Workers’ compensation does not automatically create extra FMLA weeks. [1]
Different laws provide different benefits
Workers’ compensation generally concerns benefits for a covered work injury under the applicable system. FMLA concerns protected leave, health-benefit continuation, and restoration rights for eligible employees. The employer must provide required notices and designation information. [2]
Pay and light duty need separate review
FMLA itself generally provides unpaid leave. Wage-replacement benefits and substitution of paid leave have specific coordination rules. A worker may decline a light-duty assignment while entitled to FMLA leave, but that decision can affect workers’ compensation benefits under the governing system. [1]
For example, declining light duty may preserve a qualifying FMLA absence while changing wage-replacement eligibility. Neither result should be assumed from the other law.
Prepare for return or extended restrictions
Track the FMLA balance, medical certifications, restrictions, benefit payments, and any fitness-for-duty requirement. If restrictions continue after FMLA is exhausted, disability-accommodation duties may require a separate analysis; an automatic termination date is not the entire inquiry.
Ask for written explanations of leave designation and benefit decisions. State laws or a collective-bargaining agreement may provide additional rights.
Compare the medical notices
The workers’ compensation insurer may request an injury report, the employer may request FMLA certification, and a return-to-work review may seek restrictions or fitness information. Satisfying one request does not automatically satisfy all others. Ask what information remains needed and the deadline, while keeping disclosure limited to what each process lawfully requires. If the employee returns to a voluntary light-duty arrangement, clarify how pay, leave accounting, restoration, and compensation benefits will be handled. Do not describe all hours on light duty as automatically consuming FMLA simply because the injury originally caused leave. The actual leave and duty arrangement should be documented. [1] [2]
