Can You Get a Security Clearance After a DUI?

A DUI does not automatically decide every security-clearance application, but it can raise serious concerns about judgment, alcohol use, criminal conduct, and reliability. Adjudicators evaluate the actual circumstances and mitigation, rather than applying one universal waiting period after every arrest or conviction. [1]

The pattern matters

An isolated older event with sustained responsible conduct presents different facts from repeated incidents, continued risky drinking, or failure to follow treatment or court orders. The national security guidelines consider reliability, trustworthiness, judgment, and honesty. They also identify alcohol-related concerns and circumstances that may mitigate them. [1]

For example, completing a required class is useful evidence of compliance, but it does not necessarily resolve a continuing pattern of alcohol-related problems. Conversely, seeking appropriate counseling is not itself a reason to assume a person cannot qualify.

What mitigation can show

The alcohol guideline identifies factors such as time elapsed, infrequency, unusual circumstances, acknowledgment of a problem, treatment progress, and a demonstrated pattern of modified consumption or abstinence consistent with recommendations. The weight depends on the facts; no single certificate guarantees a favorable decision. [1]

  • Final court disposition and proof of compliance.
  • Records of required education, treatment, or monitoring.
  • A clear explanation of the event and subsequent conduct.
  • Evidence that the behavior is unlikely to recur.
  • Accurate disclosure of related incidents when asked.

Answer the actual application questions

The SF86 requires complete and truthful answers and warns that withholding or falsifying information can independently affect eligibility. Its questions have different wording and timeframes. Do not assume a dismissed charge, sealed record, or old incident may be omitted without reading the relevant instructions. [2]

If a prior answer was wrong, seek guidance on correcting it through the proper process. An effort to conceal the event can create a separate credibility concern beyond the underlying DUI.

If you already hold a clearance

Follow the applicable reporting instructions and contact the security office about required disclosures. A personnel investigation, agency determination, and criminal case can proceed on different tracks. Obtain advice promptly if a statement of reasons or other adverse notice arrives.
