What Does a U.S. Marshals Hold Mean in Jail?

A jail notation reading “USM hold” generally signals a federal custody or transfer issue involving the U.S. Marshals Service. The label alone does not establish whether the basis is a criminal warrant, detention order, supervised-release matter, material-witness proceeding, or another federal process. Obtain the actual document before drawing conclusions.

Local bail may not resolve federal custody

A person may satisfy local bail conditions yet remain held under a separate federal authority. Conversely, a federal notation should not be treated as an unlimited explanation for detention without identifying the legal basis and responsible court.

In a federal criminal case, release or detention is governed by the applicable Bail Reform Act procedures. Section 3142 addresses appearance, conditions, detention hearings, and specified findings. A jail employee’s shorthand is not a substitute for the judicial order. [1]

Section 3144 permits material-witness arrest under its own conditions, including materiality and circumstances making a subpoena impracticable. It also contains limits related to securing testimony by deposition. A witness hold is not interchangeable with a criminal charge against the witness. [2]

Ask specific questions

Request the federal case number, issuing district, warrant or order information, date lodged, and office handling transfer. Ask appointed or retained counsel to check the federal docket and any sealed-process limitations. Family members should provide accurate identifying information rather than rely on a similar name in a public search.

A mistaken identity or outdated hold requires evidence and action by the authority able to correct it. The local jail may not have power to cancel a federal warrant simply because a family member says it was resolved.

Example: state charges are dismissed

If a state case is dismissed but a federal detention order remains, the state dismissal does not automatically require release from all custody. Counsel must determine whether the federal case concerns the same events, a supervision violation, or something else, and seek the appropriate hearing or correction.

Do not assume that paying another bond or hiring a commercial bondsman necessarily lifts the hold. Obtain the actual release conditions and confirm whether other detainers remain. Immigration custody can create a separate issue as well.

Keep written orders and hearing notices together. The practical objective is to identify each independent custody basis, the court or agency controlling it, and the process for challenging or satisfying it—not merely to remove an unexplained database abbreviation.

Federal timing questions include Speedy Trial Act clocks. A detention decision also requires considering constitutional bail limits.
