After qualifying FMLA leave, an eligible employee generally must be restored to the same job or an equivalent position with equivalent pay, benefits, and other terms and conditions. The rule is more substantial than merely offering any available vacancy, but it does not guarantee every incidental detail remains identical. [1] [2]
What makes a position equivalent?
Review duties, responsibilities, status, pay, benefits, schedule, location, and working conditions under the regulations. A lower-paying job with materially reduced responsibility is not made equivalent simply by preserving an employee’s title.
Protection has limits
FMLA does not give greater rights than the employee would have had without leave. An employer may establish that a genuine layoff or other lawful action would have occurred anyway. Special rules also address certain key employees and fitness-for-duty requirements. A label of “business needs” does not automatically prove an exception. [1]
For example, eliminating an entire department based on a documented plan presents different evidence from replacing only the employee who took protected leave.
Review the return instructions
Check whether a properly noticed fitness-for-duty certification is required, the anticipated return date, and any continuing restrictions. If the employee cannot perform essential functions when FMLA ends, disability-accommodation duties or state leave law may still require consideration. FMLA exhaustion is not the entire employment analysis.
Keep the preleave job description, pay records, notices, return offer, and evidence explaining changes. Raise concerns about a materially inferior position promptly.
The key-employee exception is narrow
The statute permits specified restoration limits for certain salaried eligible employees in the highest-paid10 percent within the relevant area when the required substantial and grievous economic injury standard and notice conditions are met. Being a supervisor or being difficult to replace does not automatically establish this exception. [1]
For an ordinary restoration dispute, compare the old and offered roles fact by fact. A different desk or incidental change does not necessarily defeat equivalence, while lower pay, substantially reduced responsibility, or materially worse conditions can be important. Obtain the written offer and job duties before accepting a vague assurance that the position is “comparable.” If the employer says the employee would have been dismissed anyway, request the contemporaneous evidence supporting that independent event rather than assuming the leave’s timing resolves the case.
