Can You Apply for Citizenship With an Expired Green Card?

You can generally apply for U.S. citizenship even if the physical green card has expired, provided you meet naturalization requirements. Expiration of an ordinary ten-year card is different from losing permanent resident status. Conditional residence, however, raises separate obligations that should not be ignored.

Eligibility comes from the law, not a current plastic card

Naturalization requires the applicable residence, physical-presence, good-moral-character, and other statutory conditions. An unexpired green card does not prove every requirement, and an expired one does not automatically defeat an otherwise eligible application. [1]

Review travel, absences, tax issues, criminal history, and the basis on which permanent residence was granted. Someone seeking a marriage-based shortened period has additional conditions beyond holding a card.

The N-400 receipt can extend evidence of status

USCIS announced that qualifying N-400 filings on or after December 12, 2022 receive receipt language extending green-card validity for up to 24 months from the card’s expiration. The receipt must be used with the expired card under the stated terms. It is not a new twenty-four-month period measured from whenever the applicant chooses to present it. [2]

If the card is lost, the receipt is missing, or the extension has expired, replacement or temporary evidence such as an ADIT stamp may need review. Follow the actual current notice and agency instructions.

Do not confuse renewal with removing conditions

A two-year conditional card generally involves I-751 or the applicable condition-removal process, not merely I-90 renewal. Filing N-400 does not excuse an unresolved requirement to remove conditions.

  • Confirm whether residence is conditional or permanent.
  • Calculate the correct naturalization filing window.
  • Keep the card and qualifying extension notice together.
  • Obtain current proof before employment verification or international travel when needed.

Compare filing N-400 while I-751 is pending and long trips abroad as a permanent resident. A citizenship application does not independently authorize reentry or fix a possible abandonment issue. Preserve clear status evidence while the application is pending instead of assuming the filing receipt substitutes for every required document.
