Not filing a tax return does not, by itself, automatically prevent a U.S. passport. The federal tax-related passport restriction concerns IRS certification of seriously delinquent tax debt under specific statutory requirements. An unfiled return and a certified debt are different issues.
What can trigger passport action?
Section 7345 defines the certification framework, including the debt criteria, collection-related requirements, exclusions, notice, and reversal rules. The dollar threshold is adjusted, so use the current IRS figure rather than a number copied from an older article. [2]
The IRS explains that it can certify qualifying debt to the State Department, which can deny or revoke a passport under the applicable process. A tax balance does not automatically qualify merely because it is unpaid. [1]
Unfiled returns still deserve attention
Failure to file can lead to assessments, penalties, and collection issues. It may eventually contribute to a qualifying debt even though nonfiling alone is not the passport ground. Other passport restrictions, such as child support or court orders, remain independent.
For example, someone missing a recent return with no certified qualifying debt faces a different passport question from someone who has received an IRS certification notice after collection action.
If you received a certification notice
- Check the tax periods, amounts, and certification date.
- Determine whether an exclusion or reversal basis applies.
- Use current IRS procedures to resolve the debt or challenge an erroneous certification.
- Keep written proof of any reversal and communicate urgent travel through the proper channel.
Not every payment arrangement or pending dispute automatically reverses certification. Review the actual IRS requirements and case status. Filing another passport application at a different location does not remove a certification.
Before traveling
Address both missing returns and any collection notice. Confirm passport validity and the State Department’s response rather than assuming a partial payment creates immediate clearance.
See checking a possible passport denial restriction and federal tax liens on a home. A lien, a levy, and passport certification are separate tools. Resolving one does not necessarily resolve all others, and a valid passport does not settle the underlying tax obligation.
