After an I-797 Approval: Status, Documents and Next Steps

What happens after an I-797 depends on what USCIS approved. A petition, extension, change of status, work authorization, and adjustment application have different effects. Read the notice type, underlying form, beneficiary, classification, validity dates, and any attached I-94 before treating the document as permission for a particular activity. [1][2]

Approval is not the same as a receipt

USCIS communications can acknowledge filing, request action, or announce a decision. A receipt or appointment notice should not be treated as a merits approval simply because it belongs to the I-797 notice family. The substantive decision and its terms matter. [1]

A petition approval also may not grant the beneficiary an immediate right to live or work in the United States. Determine whether a separate application, consular step, admission, or effective date remains necessary.

Status and visa questions

For a nonimmigrant case, examine whether USCIS approved a change or extension of stay and issued an I-94. A visa is a different travel document, and a petition notice is not universally a visa substitute. Travel can require review of the classification and admission documents. [2]

Check all names, dates, passport information where relevant, and the classification. If an error appears, use the appropriate agency correction process. Do not alter the notice yourself or assume the error is harmless because the headline says approved.

Cards and employment

An approval can be followed by separate document production or delivery. Track the actual EAD or green card process where applicable, and keep the mailing address current. An initial approval notice is not automatically acceptable evidence for every employer or travel carrier.

Work must fit the authorization and dates actually granted. A Social Security number does not extend an expired authorization, and a pending replacement or renewal requires its own rules.

Example: approved petition for consular processing

The petitioner may receive approval while the beneficiary still needs the applicable visa process abroad. The beneficiary should follow the agency’s instructions and any later National Visa Center or consular communications, rather than assume the notice itself authorizes entry or employment.

A different approval with an attached I-94 can have a different domestic status effect. That is why the underlying filing and full notice must be reviewed together.

Keep a complete file

Save the entire notice, envelope where relevant, prior I-94s, application receipts, and related decisions. Calendar expiration and next-action dates. If the document is missing, identify whether the problem is non-delivery, a needed duplicate, or a separate approval that never occurred before choosing the remedy.

The work question depends on the actual authorization category. A missing admission record requires I-94 troubleshooting.
