Approval of Form I-485 generally means USCIS has granted lawful permanent residence. For ordinary adjustment under 8 U.S.C. § 1255(b), the recorded admission date is the approval date. Receiving the plastic green card is a separate documentary step; certain categories, including asylee adjustment, have different residence-date rules. [3]
Read the approval and inspect the card
Save the approval notice and the complete application record. When the card arrives, compare the name, birth date, classification, expiration, and “Resident Since” date with the approval and the rules for your category. A delivery problem, a printing error, and disagreement with the underlying classification require different follow-up. Record the issue precisely before contacting USCIS.
The card-replacement regulation addresses matters such as lost, damaged, expiring cards and changed biographic information. Replacing documentary evidence does not itself redo the adjustment decision or convert a conditional grant into an unconditional one. [1]
Work and travel after the decision
Lawful permanent residents are authorized to work incident to status under 8 CFR 274a.12(a)(1). That differs from relying on a pending-adjustment employment authorization application. Employers still need acceptable evidence for employment verification; an online case-status message should not be treated as a substitute for the required documents. [2]
Before an international trip, determine what actual travel and return documents you possess. An approval notification and a green card are different documents. Avoid making a departure dependent on an assumed card-delivery date, and resolve missing or incorrect evidence before relying on it at an airport.
Check whether residence is conditional
Marriage-based residence may be conditional when the qualifying marriage was less than two years old when residence was granted. Section 1186a supplies the removal-of-conditions process, including the ordinary joint-petition filing period during the 90 days before the second anniversary of obtaining conditional residence. Waiver situations follow different requirements. A card renewal is not a substitute for removing conditions. [4]
A useful first-month checklist
- Keep approval notices and a legible copy of the card with your immigration records.
- Compare the residence date and category rather than checking only the expiration date.
- Identify any conditional-residence deadline from the actual grant.
- Maintain a reliable mailing address and follow the applicable address-update procedure.
- Plan future trips around both return documentation and continuing U.S. residence.
For example, two people approved on the same day may have different “Resident Since” dates because their adjustment categories differ. Check the legal basis before assuming either card contains a mistake.
