How to Apply for a Parent’s Green Card

A U.S. citizen who is at least twenty-one can petition for a qualifying parent as an immediate relative. A lawful permanent resident cannot sponsor a parent through that same category. The family petition establishes the relationship; the parent must still obtain an immigrant visa or qualify for adjustment of status. [1][2]

Establish the qualifying parent-child relationship

Gather proof of the child’s U.S. citizenship and documents establishing the relationship. The needed evidence can differ for a mother, father, stepparent, or adoptive parent. Name changes, prior marriages, and missing civil records should be addressed with the documents required by the current instructions. [2]

Each parent ordinarily needs a separate petition. Immediate-relative classification does not automatically give a parent’s spouse or other children derivative residence through that parent’s case. Review the eligibility of each family member instead of assuming the whole household can immigrate together. [1][2]

Choose the correct residence process

A parent abroad generally proceeds through consular immigrant-visa processing after the petition stage. A parent in the United States must independently meet adjustment requirements. Section 1255 generally requires inspection and admission or parole, admissibility, and visa availability within the applicable framework, with specific exceptions elsewhere in the law. [3]

Being the parent of a citizen does not automatically cure every entry, unlawful-presence, removal, or fraud issue. Do not send a parent abroad to finish a case without reviewing the consequences of departure. Likewise, petition approval does not itself authorize work or international travel. [2][3]

Financial sponsorship is a separate obligation

Covered cases require an enforceable affidavit of support. The sponsor must assess the current financial requirements and understand the continuing obligation. This is more than permission for the parent to stay in the sponsor’s home, and its duration does not follow an informal family repayment agreement. [4]

Prepare the case in stages

  • Confirm citizenship, age, and the qualifying relationship.
  • Review each parent’s complete immigration history.
  • File the correct current petition with supporting evidence.
  • Follow the consular or adjustment process and document requests.
  • Arrange required financial, civil, and medical materials for that route.

Immediate-relative visa availability is different from a guaranteed processing time. See Form I-130 explained and the events that end an I-864 support obligation before treating an approval notice as the end of the process.
