IF1 identifies a marriage-related adjustment route following entry as the fiancé or fiancée of a U.S. citizen. It should not automatically be described as a conditional green card. SSA’s official classification table separately identifies CF1 as the corresponding conditional category. Check the actual approval and residence rules. [3]
Understand the K-1 marriage route
The K-1 statutory framework contemplates marriage to the petitioning U.S. citizen within ninety days after admission. Adjustment restrictions for K entrants are tied to the qualifying marriage to the original citizen petitioner. The admission, marriage, and adjustment records must therefore be considered together. [2][4]
A late marriage requires careful analysis of the resulting status and filing requirements; it should not be reduced to an unsupported statement that every later marriage makes adjustment impossible. Likewise, marrying someone else should not be assumed to provide the same adjustment route as marrying the original K-1 petitioner. [2]
When residence is conditional
Section 1186a generally imposes conditional residence for the covered marriage-based grant when the qualifying marriage was less than twenty-four months old when residence was obtained. The marriage’s age at the residence grant matters, not simply the age of the relationship when the visa was issued. [1]
For example, a person adjusting after a qualifying marriage has reached two years presents a different conditional-residence question from someone approved only months after the wedding. Compare the card’s classification, expiration, approval notice, and marriage date rather than relying solely on a description found online. [1][3]
Sponsorship and conditions are different obligations
The enforceable affidavit-of-support framework in § 1183a addresses financial sponsorship, household resources, and the sponsor’s obligations. It does not decide whether a marriage-based resident must remove conditions. Satisfying one part of the immigration process does not replace the other. [5]
Use the applicable affidavit requirements and supporting financial records for the adjustment case. Keep copies because sponsorship obligations can continue after the green card is issued under the statute’s termination rules. [5]
If the actual grant is conditional
The ordinary joint removal-of-conditions petition is filed during the ninety-day period before the second anniversary of obtaining conditional permanent residence. Statutory waiver circumstances have separate requirements and should be examined when a joint filing is unavailable. A routine card replacement does not itself remove conditions. [1]
If an IF1 or CF1 label appears inconsistent with the underlying grant, preserve the documents and seek correction or clarification through the appropriate procedure. Do not self-correct the card, ignore a genuine conditional deadline, or assume that every person with an IF1 classification needs an I-751.
