Buy America compliance starts with the funding and contract regime. Build America, Buy America requirements for covered federal financial-assistance infrastructure projects differ from the Buy American rules for federal procurement. A domestic-content conclusion under one program does not automatically satisfy another. [1] [2]
Classify each item correctly
Part 184 distinguishes iron or steel products, manufactured products, construction materials, and specified excluded materials. Categorization determines the domestic-production test. The manufactured-product rule generally includes U.S. manufacture and the required domestic-component cost percentage, while construction materials have material-specific process requirements. [1]
Flow the requirement down
The federal award’s terms must reach relevant subawards, contracts, and purchase orders. A recipient should not wait until installation to ask suppliers for origin and manufacturing information. Agency-specific requirements and approved waivers can change the applicable analysis. [1]
For example, a distributor’s U.S. address does not establish where a product was manufactured or whether its components satisfy the required test.
Keep a defensible file
Maintain award clauses, product classifications, manufacturer certifications, supporting manufacturing and cost records, purchase documents, and any approved waiver. A vendor’s informal “American made” marketing claim is not a substitute for the governing standard.
Waivers need actual authority
Nonavailability, public-interest, or cost-based exceptions depend on the applicable law and agency process. Document the approved scope, dates, and products rather than assuming a pending waiver request permits installation.
Use the correct manufacturing test
For covered manufactured products, the general Part 184 definition requires U.S. manufacture and more than 55 percent domestic component cost, unless a governing standard meeting or exceeding it applies. That is not simply55 percent of the purchase order or labor cost at the project site. Iron and steel use a different manufacturing-process rule, including the specified initial-melting-through-coating requirement. [1]
Specified cement and aggregate materials have their own exclusion from the construction-material definition, but an excluded raw material can appear as a component of a covered manufactured product. Do not treat the category label as a universal exemption from every agency program. Obtain product-level information early enough to resolve classification, component cost, and manufacturing origin before incorporation. A substitution should be reviewed against the same award requirements rather than assumed compliant because the originally approved supplier was domestic.
See federal funding and Bayh-Dole compliance and construction accessibility responsibilities. A project can have several independent compliance duties that require separate documentation.
