Can H-4 Dependents Work in the United States?

H-4 status alone does not authorize employment. Certain H-4 spouses of H-1B workers may apply for employment authorization, but H-4 children do not qualify through that spousal provision. An eligible spouse must obtain the required employment authorization before starting work unless another independent authorization applies. [1][2]

Which spouses can qualify?

The regulation provides two principal paths: the H-1B spouse is the beneficiary of an approved immigrant worker petition, or the H-1B spouse has an authorized H-1B stay under Sections 106(a) and (b) of AC21. A pending employment-based immigration process does not automatically satisfy either path. Verify the actual approval or extension basis. [1]

The application must establish the marriage and the principal worker’s qualifying H-1B circumstances, as well as current H-1B and H-4 status. The EAD category appears in 8 CFR 274a.12(c)(26). It is an application-based category rather than employment authorized simply by holding an H-4 admission record. [1][2]

Prepare the application around current records

  • Review both spouses’ latest admission and approval records.
  • Collect marriage documentation and evidence of the qualifying immigrant petition or AC21 extension.
  • Use the current Form I-765 instructions, edition, and fee requirements.
  • Track the EAD expiration separately from the visa stamp and status expiration.

These documents serve different purposes. An unexpired visa stamp does not by itself establish current work authorization inside the United States, and an EAD does not independently extend H-4 status.

Renewal filing does not always extend the old card

The October 14, 2026 final rule preserves the cutoff introduced for renewal applications filed on or after October 30, 2025: those filings generally do not receive the former automatic employment-authorization extension. Qualifying earlier filings and extensions supplied by separate law or specific notices require their own analysis. Do not assume that every timely H-4 EAD renewal receipt permits continued work. [3]

Plan the renewal around the current rule, filing window, and underlying status. If the card expires before a new authorization is effective, confirm the actual legal basis before continuing paid work or self-employment.

For a principal worker’s move, see changing H-1B employers during processing. employment authorization renewal extensions explains why receipt notices must be evaluated by category and filing date.
