Can You Be Fired After FMLA Runs Out? ADA and Other Rights

An employer does not have to provide unlimited FMLA leave, but exhausting FMLA does not automatically resolve every employment protection. The employer may need to consider ADA accommodations, state law, its own policies, and whether retaliation or another unlawful reason is involved. The result depends on the job and facts. [1][2]

Confirm that FMLA is actually exhausted

Review the employer’s leave year, designation notices, work schedule, and accounting. An employee may dispute whether certain absences were properly counted or whether a new entitlement period has begun. A manager’s statement that “twelve weeks are over” should be compared with the actual record.

FMLA restoration rights and exceptions follow the statutory framework. They do not guarantee a job indefinitely after protected leave ends, but the employer still cannot punish the employee for having used protected leave. [2]

ADA leave or another accommodation

For a qualifying disability, additional finite leave or another effective adjustment can be a reasonable accommodation in appropriate circumstances, absent undue hardship. The analysis is individualized. An employer should not assume that its standard maximum-leave policy always ends the inquiry. [1]

The employee must also address essential job functions and the anticipated ability to return. A request for leave with no meaningful information about duration or future ability can present different issues from a supported request for a defined recovery period.

Other possible changes can include a modified schedule, equipment, or reassignment where the applicable requirements are met. The ADA does not automatically require creating a new job or accepting every proposed arrangement.

Example: a defined follow-up treatment period

An employee expects to return after a short additional treatment period and provides appropriate functional information. The employer should evaluate the actual request and hardship rather than reject it solely because FMLA ended. That does not guarantee approval; the relevant evidence and legal standard still control.

Keep requests, medical restrictions, expected return information, proposed alternatives, and responses. The provider should describe supported limitations without supplying unrelated medical details.

If termination occurs

Obtain the stated reason and compare it with earlier communications, performance records, and the accommodation process. A genuine independent reason can differ from using leave or a disability request as a negative factor.

Internal appeals and discussions do not necessarily pause outside filing deadlines. Identify whether the concern belongs under FMLA, the ADA, state leave law, a contract, or several routes, and preserve each applicable deadline while seeking advice.

Compare FMLA retaliation with anxiety-related accommodation requests. Additional time also raises leave-extension questions.
