An asylum application does not itself authorize employment. A qualifying applicant may request an asylum-based EAD after the applicable waiting period, and employment authorization generally cannot be granted before 180 days of countable time. The filing threshold and approval threshold are different. [1]
Understand the asylum clock
The regulation generally permits filing after 150 days, with applicant-caused delays affecting the count. Rescheduling, missing a required appointment, or requesting certain postponements can change the calculation. Countable time is not necessarily the number of days since a package was mailed.
Eligibility can also depend on how the asylum claim was filed and the applicant’s case history. A different valid work-authorized status or EAD category requires a separate analysis. [2]
Apply and verify before working
Use the current I-765 instructions and correct eligibility category. Keep the asylum receipt, clock information, relevant court notices, and the EAD application receipt. Filing an initial application is not permission to start work.
Check the actual expiration date and renewal rules before relying on an existing card. A renewal receipt does not create an automatic extension for every category or filing circumstance. If the clock appears wrong, seek correction through the agency or court handling the asylum case rather than submitting invented dates.
Example: calendar days versus countable days
An applicant may have filed asylum many months ago yet have fewer countable days because of a delay attributed to the applicant. Before sending I-765, obtain the case’s actual clock information and compare it with notices explaining any stopped period. Mailing the work-permit request with an optimistic calendar calculation does not resolve the underlying clock issue.
A missed asylum interview or court event can create problems beyond employment authorization. Keep a record of attendance, rescheduling requests, and agency responses. If a delay was attributed incorrectly, ask the responsible office or court how to request correction with supporting records.
When an EAD is approved, check the category and dates before accepting work. A Social Security number is not an independent work permit. Employers must verify authorization through the applicable I-9 rules, while the applicant remains responsible for the asylum case and any separate renewal requirements. Obtain current guidance if the asylum decision or removal proceedings change while an EAD application is pending.
The responsible agency depends on where the asylum claim belongs. Replacing an existing document follows the lost-EAD process.
