A settlement’s effect depends on the benefit program and the nature of the payment. Ordinary compensatory damages generally do not create an asset test for retirement or SSDI. SSI, workers’ compensation offsets, public disability benefits, and settlement components require separate analysis. [1]
Rules that determine the answer
SSI can count settlement proceeds as income when received and as resources if retained, subject to exclusions. Certain trusts, ABLE accounts, or excluded reimbursements have detailed conditions. For SSDI, workers’ compensation or qualifying public disability payments can reduce benefits; a lump-sum label does not necessarily avoid an offset. [1] [2]
A structured settlement does not automatically solve an SSI problem. Timing, control, ownership, and the payment’s legal character matter. Consider benefit planning before funds are disbursed because some later transfers have adverse consequences.
What to check before taking the next step
- Obtain the proposed allocation before signing and identify each benefit you receive.
- Check the award or decision letter to confirm whether the payment is retirement, SSDI, a dependent benefit, SSI, or a combination. These programs can apply different income and reporting rules.
- Keep the settlement agreement, fee statement, lien information, payment schedule, and benefit notices, and give SSA the relevant dates and amounts rather than only an estimate.
- Ask for a written explanation of any change. If you disagree, use the review procedure and deadline on the notice, and retain proof that SSA received your request.
Practical example
A personal-injury settlement and a workers’ compensation compromise are not interchangeable. The second may trigger an SSDI offset even where the first does not reduce SSDI under an income test.
