A teacher can qualify for H-1B sponsorship when the actual position is a specialty occupation and the teacher meets its related education and other requirements. The employer must document the job rather than rely solely on the title “teacher” or the employee’s possession of a degree. Current specialty-occupation rules require an appropriate relationship between the qualifying degree field and the duties. Required state teaching authorization also needs attention before the proposed work begins. [1]
Rules that determine the answer
The school’s cap status is a separate question. Qualifying institutions of higher education, related or affiliated nonprofit entities, and qualifying research organizations have specified cap exemptions. A public K–12 district is not automatically exempt merely because it is governmental, and nonprofit status by itself does not establish the required university affiliation. Current regulations address qualifying affiliations and work performed for qualifying organizations; the actual relationship and assignment must satisfy the rule. [1] [2]
For FY 2027, the cap-selection rule effective February 27, 2026 uses wage-weighted selection when selection is needed; it is inaccurate to describe the process as an equal-chance lottery for every registration. [4] Fees also require current legal review. Although a September 2026 proclamation extended the $100,000 entry-payment policy, the September 30 Global Nurse Force order set aside implementing agency policies under both proclamations and noted the existing vacatur and appellate stay denial. Schools should not treat $100,000 as automatically collectible merely because the proclamation exists. [5] Verify the current court and USCIS position at filing, separately from ordinary petition fees and cap eligibility.
What to do next
- Document the teaching duties, required degree fields, teacher’s credentials or equivalency, and applicable state license or authorization.
- Determine whether the petition is cap-exempt or cap-subject and preserve evidence supporting the exemption rather than using a generic affiliation letter alone.
- Obtain the required certified Labor Condition Application, including correct worksite and wage information, before filing Form I-129. DOL requires the higher of the applicable prevailing wage and actual wage paid to similarly qualified workers. [3]
- For cap-subject cases, follow the current registration and selection process and filing window. Confirm a lawful employment start date; an LCA or registration selection alone does not authorize classroom work.
- Calculate current employer fees and review any petition, entry, and litigation-related requirements using current instructions before submission.
Practical example
A university hires a qualified lecturer for a documented specialty teaching position. Its qualifying institutional status may support cap exemption. A nearby school district hiring a science teacher cannot assume the same result merely because students sometimes visit the university. It must establish its own qualifying basis or use the applicable cap-subject process.
