How Long Can a Green Card Holder Stay in India?

Green card holders do not have a special U.S. residence rule for India. The trip can affect both proof for returning to the United States and whether permanent residence or naturalization continuity is preserved. [1]

A return document is only part of the analysis

A green card generally serves as a return document after a temporary absence of less than one year, subject to applicable rules. Longer travel may require a reentry permit or returning-resident visa analysis. Even a shorter trip can raise abandonment concerns if residence was moved abroad. [1]

Naturalization has separate continuous-residence and physical-presence requirements. Absences over six months and those of a year or more can have different consequences. [2]

Keep evidence of the temporary purpose

Document travel dates, employment, your U.S. home, family ties, tax filings, and the reason for an extended stay. A valid reentry permit protects against an abandonment finding based solely on the duration of an absence while it is valid; the holder must still be otherwise admissible. It does not automatically preserve naturalization continuity. [3][2]

Before traveling, check the Indian visa or OCI rules that apply to your passport and planned stay. Treat that inquiry separately from the U.S. rules for returning as a permanent resident.

Practical application

Someone whose stay in India was extended by a family medical problem should preserve contemporaneous travel and medical records. If a returning-resident visa is needed, the State Department asks for evidence of resident status, departure dates, intent to return, and why a prolonged stay resulted from circumstances beyond the traveler’s control. A family obligation does not automatically establish every requirement. [4]

An absence can affect naturalization separately

For naturalization, an absence of more than six months but less than a year can raise a rebuttable continuous-residence issue, while a year or more generally has more serious consequences subject to specified exceptions. Physical presence is another calculation. Someone may therefore be able to seek return as a permanent resident yet need additional time or evidence before naturalizing. Keep every departure and return date, not only the longest trip. A reentry permit and an Indian residence permission address different legal questions and should not be treated as interchangeable protections. [1] [2]
