How Long Can You Stay After a U.S. Visa Expires?

The expiration date on a visa stamp generally controls when the visa may be used to seek entry, not how long an admitted visitor may remain. The admission record and status rules control authorized stay. [2]

Check the I-94

A date-certain I-94 usually identifies the authorized admission end date. Older records may show duration of status, which requires checking the current transition rules rather than assuming an unlimited admission. Visa validity, petition validity, status, and authorized stay are related but different concepts. [1]

A timely extension or change request can have specific consequences, but filing one does not automatically grant the requested status or permission to work. [1]

Address an expiring admission promptly

Retrieve the I-94, compare it with the passport and approval notices, and correct errors through the responsible agency. Review options before the authorized period ends. [1]

Overstay, unlawful presence, and status violations have distinct rules and exceptions. Do not calculate a departure deadline solely from the visa sticker or assume a universal grace period applies. [1]

Practical application

A visitor admitted until a particular date can sometimes remain lawfully after the visa sticker expires, while a person with a valid sticker can still overstay an earlier I-94 date. Compare the two documents rather than choosing the later date. Where admission is for duration of status, compliance with the classification’s conditions remains essential; it is not permission to remain without any continuing obligations. [1]

Permission to enter can outlast or underlast the visa

The State Department explains that a visa permits travel to a port of entry to request admission. The admitting authority determines the authorized period in the United States. An extension or change-of-status approval can create a later relevant admission record without replacing the visa stamp used for future travel. Before leaving and attempting return, determine whether a valid visa is required and whether an exception applies. Being allowed to remain inside the country and being able to seek a new admission are different questions; neither should be decided by examining only one date on the passport. [1] [2]

The 2026 F and J transition

The current regulation applies a fixed-admission framework to covered new F and J admissions after September 15, 2026. It separately provides transition rules for qualifying people already properly maintaining status under earlier duration-of-status admissions. Their individual program and authorization dates matter, subject to the regulatory limits. It does not say that every earlier admission ended on the same day. An old D/S entry should therefore be reviewed with Section 214.1(m) and current program records. [1]
