Can an L-2 Child Get an SSN? Nonwork and ITIN Rules

An L-2 child generally cannot obtain a work-authorized Social Security number solely from L-2 dependent status. The employment rules for an L-2 spouse do not automatically apply to a child. A narrow valid-nonwork-reason exception may permit an SSN, while a tax need may instead call for an ITIN.

Distinguish spouses from children

SSA’s admission-class guidance distinguishes employment-authorized spouses from dependent children. An L-2S designation for a spouse and an L-2Y designation for a child are not interchangeable. Check the actual I-94 and current status rather than assuming all family members have the principal worker’s employment rights. [1]

The nonwork exception is limited

SSA can assign an SSN for specified nonwork reasons involving a federal requirement for a federally funded benefit or a qualifying state or local requirement for public assistance, when the other conditions are met. A school, bank, or insurer’s preference for an SSN is not automatically a qualifying statutory need. [2]

The benefit agency generally must explain the legal requirement and confirm the person otherwise qualifies. SSA also needs appropriate identity, age, and immigration-status evidence. A nonwork SSN does not authorize a job.

When an ITIN may fit

The IRS issues an Individual Taxpayer Identification Number to people who need a U.S. taxpayer identification number but are not eligible for an SSN. The application requires a qualifying tax purpose and the applicable documentation or exception. An ITIN does not confer immigration status, work authorization, or Social Security eligibility. [3]

For example, a parent preparing a federal return may need to examine the child’s tax identification and dependent rules. That does not mean obtaining an ITIN automatically makes every dependent credit available.

  • Confirm the child’s current admission class.
  • Ask why the requesting organization needs a number.
  • Determine whether a legal nonwork SSN requirement actually applies.
  • Use current IRS instructions if an ITIN is appropriate.

See whether an I-94 permits employment and distinguishing visa and admission-record numbers. Never use a parent’s SSN as though it belongs to the child or invent a number to complete an application field.
