Divorce After Filing I-751 Jointly: Amending the Case

A final divorce changes the basis of a jointly filed I-751. It does not automatically prove the marriage was fraudulent, but USCIS generally can no longer adjudicate the case as a joint filing once the marriage is legally terminated. Notify the agency and determine the appropriate waiver or amendment process. [1][2]

Separation and final divorce differ

An existing joint petition can present different issues while the spouses are separated or a divorce is pending. USCIS’s published guidance distinguishes those situations from a final legal termination and addresses withdrawal of support as another relevant event. [2]

Do not describe yourself as divorced merely because papers were filed. Keep the actual decree and its effective date. If the case is not final, explain that accurately when responding to a request.

Good-faith marriage waiver

The statute provides a waiver route involving a marriage entered in good faith that later ended, subject to its requirements. The focus is the genuine relationship, not whether the couple ultimately stayed together or which spouse was blamed in divorce court. [1]

USCIS may provide an opportunity to amend an existing joint filing to an individual filing. Follow the notice and current instructions rather than assume a duplicate I-751 and fee are always necessary or that no action is required. [2]

Other waiver bases, including specified abuse or hardship circumstances, have different requirements. Select the basis supported by the actual facts and consider appropriate confidentiality procedures.

Example: divorce becomes final while an RFE is pending

The applicant should identify the requested evidence, provide the final decree when available as required, and clearly request the proper case treatment. A divorce order alone may not establish every good-faith element, so preserve earlier shared-life evidence.

Useful materials can include residence, financial, insurance, family, and other reliable records from the relationship. Explain gaps or changed circumstances honestly. Do not obtain a former spouse’s false statement simply to preserve the appearance of an ongoing marriage.

Keep deadlines and status documents separate

Read all requests and interview notices. An inquiry or pending divorce does not automatically extend an agency deadline. If final documents are unavailable, seek advice about the appropriate response instead of ignoring the notice.

The card’s expiration and any receipt-based extension are separate documentation issues. Keep the actual extension notice and review its terms before work or travel. If removal proceedings or another serious complication arises, obtain individualized advice about jurisdiction, waiver timing, and the pending petition rather than assuming divorce alone settled the outcome.
