A downward departure is a sentence below the otherwise applicable advisory Guidelines range based on a departure provision or framework recognized by the Guidelines. A variance instead rests on the court’s consideration of the statutory sentencing factors. Both can lower a sentence, but they are not interchangeable labels. [1][2]
Start with the correct range
The court first needs the applicable statutory range and a properly calculated Guidelines range. Disputes about offense level, criminal history, loss, role, or another adjustment are different from asking to depart from the resulting range.
A departure request should identify the relevant authority and facts. A variance request should connect the evidence to section 3553(a), including the offense, personal history, sentencing purposes, and other statutory considerations. Simply asking for mercy does not explain why a particular sentence is legally appropriate. [1]
Mandatory minimums remain important
The Guidelines are advisory, but a statutory mandatory minimum can still bind the court. A departure or variance does not by itself authorize going below that minimum. Statutory mechanisms such as qualifying safety-valve relief or a government substantial-assistance motion have their own requirements. [1][2]
A Guidelines assistance motion and statutory authority to sentence below a minimum must be examined separately. Do not assume that cooperation guarantees a motion or a particular reduction.
Example: an unusually difficult personal history
A defendant may present treatment records, caregiving responsibilities, rehabilitation, and other supported facts. Counsel should explain how those circumstances relate to the requested legal framework and proposed sentence. The court may consider competing facts, including harm to victims and the need for deterrence.
An unsupported claim about medical needs is less useful than reliable records and a realistic treatment or release plan. Avoid submitting letters that minimize admitted conduct or contradict the defendant’s own position without discussing them with counsel.
What to prepare
Obtain the presentence report, objections, sentencing memoranda, relevant records, and a clear proposal. Separate contested Guidelines calculations from departure grounds and statutory variance arguments. Explain which findings or government actions are prerequisites to the requested result.
There is no fixed percentage associated with the phrase “downward departure.” The amount and availability depend on the authority and facts. A court’s sentence in another case can be informative but is not a promise of the same result.
The written judgment and hearing transcript should be checked afterward to understand what the court actually granted and why, especially if appeal or later sentence-computation questions arise.
Drug cases require checking statutory minimums under section 841. Prepare for the sentencing hearing separately from estimating time ultimately served.
