What Qualifies for an EEO Complaint at Work?

An EEO complaint generally concerns discrimination or retaliation prohibited by an applicable employment-equality law. Unfairness alone is not always unlawful discrimination. The facts should connect the treatment to a protected basis, protected activity, accommodation obligation, or another right enforced through the relevant process. [1]

Rules that determine the answer

For covered nonfederal employers, EEOC handles claims under statutes addressing race, color, religion, sex, national origin, disability, age, genetic information, and related retaliation, with coverage and standards differing by law. Federal employees ordinarily begin with agency EEO counseling, generally within forty-five days. Private-sector charges generally have a 180-day period, potentially extended to 300 days under applicable conditions. [2]

Retaliation can be unlawful even where the underlying discrimination allegation is not ultimately proved, if the protected-activity requirements are met. Harassment standards also differ from an ordinary personality conflict. State laws may protect additional characteristics or cover smaller employers, so a federal coverage problem does not necessarily resolve every possible claim. [1] [2]

What to check before taking the next step

  1. Identify the employer, adverse action or harassment, protected basis or activity, and relevant dates.
  2. Describe specific events, decision makers, witnesses, and comparisons rather than only use labels such as “hostile.”
  3. Preserve communications, performance records, accommodation requests, and complaints.
  4. Use the correct filing route; an internal HR report is not automatically an EEOC charge or federal EEO counseling contact.

Practical example

A worker complains that a supervisor favors a personal friend. That alone may be unfair without establishing an EEO claim; evidence that protected leave or race drove the decision changes the legal question.
