The immigration court handling your case is generally identified by the filed charging document and subsequent court orders. The regulation states that jurisdiction vests and proceedings begin when the charging document is filed with the immigration court, subject to applicable law and exceptions. Receiving papers from DHS and having an active court docket are related but distinct events. [1]
Confirm the current court record
Use your notices, A-number, EOIR’s official case-information resources, and counsel’s records to identify the court, hearing date, and case posture. A transfer or venue order can change the location. Do not rely solely on where you currently live or where an enforcement encounter occurred.
Bond proceedings can have different jurisdictional rules from the underlying removal case. USCIS applications and BIA appeals also are not automatically filed with the court holding the removal record.
Moving does not automatically move the case
Update the required address record, but understand that an address change is not itself an approved change of venue. Section 1003.20 permits venue changes for good cause on a party’s motion, after the charging document is filed and the opposing party receives the required opportunity to respond. A fixed address for future notice is required. [2]
For example, someone who relocates across the country should not skip the scheduled hearing on the assumption that the new local court will take over. The original obligations generally remain until an effective order changes them.
What a venue request should address
- The existing case and scheduled hearing.
- The requested court and reliable new address.
- The reasons supporting good cause.
- Required positions, procedural information, and service.
- The need to continue complying while the request is pending.
Challenges involving defects in a Notice to Appear require current controlling decisions. Do not assume every missing detail automatically destroys jurisdiction or dismisses the case; claim-processing and other legal questions can differ.
Compare motions to reopen an immigration case and ICE detainers. A detention location, administrative request, court venue, and appellate forum serve different purposes. Before sending a filing, identify which agency or tribunal currently has authority to decide that specific request.
