Working With an Expired Work Permit: What to Check

If your work authorization has expired and no independent authorization or valid extension applies, continuing to work is unauthorized. A pending renewal does not necessarily allow continued employment. The first step is to identify whether the card’s expiration also ends the underlying work permission, because immigration categories operate differently.

Read the category and the legal basis

Some people are authorized to work incident to status, while others need an approved employment authorization application. The regulation expressly states that expiration of a permanent resident’s Form I-551 reflects a need to renew the card, not expiration of the person’s work authorization. That rule should not be applied automatically to a temporary EAD holder. [1]

For example, an expired green card and an expired C33 DACA EAD present different issues. The documents may both contain expiration dates, but those dates do not have identical legal significance.

Renewal filing is not always an extension

The October 14, 2026 final rule reaffirmed the2025 removal of the general regulatory automatic-extension mechanism for renewals filed on or after October 30, 2025. Qualifying earlier filings and extensions provided separately by law or specified Federal Register notices require their own analysis. A receipt alone should not be assumed to provide180 or540 additional days. [2]

What a work gap can affect

Unauthorized employment can create immigration complications, including issues in later benefit applications. Exceptions and consequences depend on the application category and individual history. It is inaccurate to say that every period of unauthorized work automatically produces the same permanent bar.

Employers also must evaluate continuing employment authorization under employment-verification rules. A pending application, an online status update, and an approval notice are different kinds of evidence. Avoid asking an employer to accept a document that does not actually establish authorization.

Practical next steps

  • Collect the EAD, I-94, approval notices, and renewal receipt.
  • Confirm the category and relevant filing and expiration dates.
  • Check for a specific valid extension or independent authorization.
  • Discuss an employment pause if authorization is ending.
  • Seek immigration advice before continuing unauthorized work.
