H-1B Approved but Not Stamped: Status and Travel Rules

An approved H-1B petition without a visa stamp can have different consequences depending on whether USCIS also granted a change or extension of status. Read the approval notice and I-94 before assuming you may start work. Petition approval, lawful status, a visa, and admission are separate decisions.

Check the approval notice

An approval with a new I-94 can establish an approved in-country status period, subject to the notice’s terms and effective dates. Approval for consular notification alone generally does not place someone already in the United States into H-1B status. Existing authorization or a separate rule must support work before the relevant H-1B authorization begins.

For example, an F-1 student whose petition was approved for consular processing should not assume the approval automatically ended the need to observe F-1 employment rules.

When a visa stamp is needed

For most applicants requiring a visa, the approved petition supports a separate State Department visa application before seeking H-1B admission from abroad. A petition approval is not a visa guarantee, and additional administrative processing can affect travel timing. Certain nationality-based visa exemptions and limited revalidation rules require separate review. [1]

A person lawfully working in H-1B status inside the country does not ordinarily need to obtain a new visa merely to continue that authorized domestic stay. International departure changes the practical question because returning requires the appropriate documents and eligibility.

Review the admission record after travel

CBP’s I-94 documents the admission classification and authorized period. After entry, check it against the passport, visa, and petition notice. The visa’s expiration and the I-94’s admitted-until date serve different functions. [2]

  • Confirm whether the approval includes an I-94.
  • Check the employer, classification, and validity dates.
  • Plan for consular processing and possible delays before leaving.
  • Correct an erroneous admission record through the proper process.

See what happens after an H-1B job ends if the employer relationship changed. visa-number and I-94 differences helps distinguish document identifiers from status dates. Do not make nonrefundable travel plans based only on the word “approved” in an online case-status update.
