C09 identifies a work-permit category tied to a qualifying pending adjustment application; it is not a visa or a green card. For renewals, the key question is not simply whether Form I-765 was sent before the card expired. The filing date and the current automatic-extension rules determine whether a receipt supplies any additional authorization. [1]
Rules that determine the answer
DHS ended the ordinary automatic-extension provision for covered EAD renewals filed on or after October 30, 2025. The October 14, 2026 final rule reaffirms that rule and preserves the stated treatment of earlier extensions and limited extensions provided by law or Federal Register notice. A general promise of 540 days for every timely C09 renewal is no longer accurate. [2]
A separate USCIS policy reduced the maximum validity for covered pending-adjustment EAD applications pending or filed on or after December 5, 2025 to eighteen months. [3] That policy concerns the period USCIS grants on an EAD; it is different from extending an expired card while a renewal waits. An existing card, a qualifying older automatic extension, and a newly issued card should therefore be evaluated separately. File early enough under the applicable instructions to reduce avoidable gaps, but do not treat early filing as a guarantee of approval before expiration. Keep immigration-status questions separate from employment authorization: neither the receipt nor the card alone resolves every status issue.
What to do next
- Find the current card’s category and expiration, and the renewal’s actual received date.
- Confirm that the underlying I-485 remains pending and that the renewal was properly filed in the correct category.
- If relying on a pre-change extension, verify every eligibility and termination condition and keep the supporting card and receipt.
- Coordinate Form I-9 reverification with the employer using valid documentation rather than assume a pending case prevents an authorization gap.
Practical example
An otherwise qualifying C09 renewal received October 29, 2025 can present a different extension analysis from one received October 30. Merely showing that both were filed before their cards expired does not eliminate that transition-date distinction.
