A C09 employment authorization document generally is based on a qualifying pending adjustment-of-status application under INA section 245. Filing an I-130 alone does not establish C09 eligibility, and filing an I-765 alone does not authorize employment. The applicant must fit the category and obtain valid authorization. [1]
Rules that determine the answer
USCIS’s December 2025 policy reduced the maximum EAD validity for pending-adjustment applicants from five years to eighteen months for covered applications pending or filed on or after December 5, 2025. The actual card and applicable policy determine the authorized dates; the change should not be described as automatically cancelling every older five-year card. [2]
Renewal receipts require particular care. DHS ended the ordinary automatic-extension mechanism for covered renewal applications filed on or after October 30, 2025, with limited statutory or Federal Register exceptions; the October 2026 final rule reaffirms that approach. An older explanation promising every timely C09 renewal 540 extra days is therefore unreliable. Preserve any extension already valid under transitional rules and verify its precise conditions. [3] An EAD also is not a travel document and does not itself grant permanent residence or guarantee approval of the I-485.
What to do next
- Confirm the I-485 is properly filed and remains pending, and identify the correct I-765 category.
- If filing I-765 separately, include the I-485 receipt or other required proof of the pending case.
- Submit identity evidence, prior EAD information, photos, signatures, and the current applicable fee under the instructions.
- Track the EAD expiration independently of the green-card case and plan for renewal processing before employment authorization ends.
Practical example
An applicant has an approved family petition but has not filed I-485. The petition does not by itself permit a C09 application. A second applicant with a qualifying pending I-485 can apply, but must still wait for employment authorization before starting work.
