School Security Cameras and FERPA Access

School security footage can become an education record under FERPA when it is directly related to a student and maintained by the school or a party acting for it. Not every camera recording has that status. [1]

Context controls the classification

Footage used to discipline a student may directly relate to that student. A recording can relate to multiple students. Records created and maintained by a school law-enforcement unit for a law-enforcement purpose have a distinct FERPA exception. [2]

FERPA access rights do not automatically require giving every requester an unrestricted downloadable copy containing other students. [2]

Make a focused request

Identify the incident, date, location, and student relationship. Ask the school to preserve relevant footage before routine deletion. The school may need to arrange inspection or address other students’ information under the applicable rules. [1]

Camera placement and recording in private spaces can raise separate state privacy and school-policy issues. FERPA alone is not a complete camera-placement code. [1]

Practical application

A parent requesting a hallway video should specify the time window and incident and ask for preservation promptly. If several students are involved, the school must consider the applicable access rules and whether segregation or redaction can reasonably be accomplished. A record kept by the school’s law-enforcement unit for its own enforcement purpose requires a different analysis from footage maintained by administrators for student discipline. [2]

Access can involve multiple students

Education Department guidance explains that a video can directly relate to more than one student. The school must assess the relevant access rights and whether portions can reasonably be segregated or redacted. An inspection opportunity and a right to receive a copy are not always the same. A requester should identify the student and incident clearly and ask how access will be provided under the applicable rules. If the school says the law-enforcement-unit exception applies, ask which unit created and maintains the record and for what purpose, because a camera’s location alone does not decide the exception.
