A felony conviction does not by itself impose a universal federal ban on obtaining a U.S. passport. Specific statutes, court restrictions, and passport regulations determine ineligibility. The offense, its connection to international travel, and the person’s current legal circumstances matter. [1] [2]
Certain drug convictions have a specific rule
Section 2714 addresses qualifying convictions involving controlled substances and use of a passport or crossing an international border in committing the offense. It distinguishes covered felony convictions from the discretionary treatment of certain misdemeanors and defines the relevant period of ineligibility. Read the actual statutory conditions rather than treating every drug conviction as identical. [1]
The statute also contains specified exception authority. A personal need to travel does not itself establish an exception or allow use of a passport that was revoked.
Other restrictions can matter without a new felony
Passport regulations address circumstances such as qualifying warrants, court orders, and other statutory restrictions. Child-support certification and certain tax-related restrictions are separate from a blanket rule about felony records. A valid-looking card or booklet should not be used if it has been revoked or if travel violates a court order. [2]
Passport issuance and permission to leave during probation, supervised release, or another court process are different questions. Destination countries also make their own admission decisions; a U.S. passport does not guarantee entry elsewhere.
Review the record before applying or traveling
Obtain the judgment, current supervision conditions, relevant warrants or orders, and any passport decision. Identify the exact ground the agency relies on. Correct an inaccurate court or agency record through the responsible process rather than assume a new application bypasses it.
For example, a person with an old unrelated conviction may face no conviction-based passport bar but still need court permission for travel under current supervision. Another person may face a specific drug-related statutory restriction. Those situations require different responses. Read any denial or revocation notice for available review instructions, and confirm that a usable passport and all required travel permissions are actually in place before departure. [1] [2]
