Ordinary FMLA leave does not automatically extend beyond twelve workweeks in the applicable leave year. Additional time may be available under a different entitlement, the military-caregiver provision, disability accommodation, state law, or employer policy. Extra leave is not always an extension of the original FMLA protection.
Check the FMLA calculation first
Confirm the employer’s leave-year method and the time actually used. Intermittent schedules, holidays, and part-time work can affect the calculation. The statute separately provides up to twenty-six workweeks in a single twelve-month period for qualifying military-caregiver leave, subject to its requirements. [1]
That military provision is not a general additional fourteen weeks for every serious health condition. A new leave year also does not automatically make an employee eligible without reviewing the applicable rules.
The ADA can require a separate review
A covered employer may need to consider additional unpaid leave as a reasonable accommodation for an employee’s disability, absent undue hardship. EEOC guidance explains that exhausting FMLA or an employer’s ordinary leave policy does not alone end the ADA inquiry. [2]
Useful information includes the reason for additional leave, expected duration, likely return, essential job functions, and possible alternative accommodations. Indefinite leave and a short, supported recovery extension can present different legal questions.
For example, a provider’s estimate that three additional weeks will permit return after surgery supports a more concrete discussion than an unexplained request to remain absent indefinitely. The employer must still evaluate the actual circumstances and applicable law.
Pay, insurance, and reinstatement need separate answers
State paid-leave benefits, disability insurance, and employer leave programs may provide income or additional time, but do not necessarily create identical job protection. Ask how health coverage continues and whether a contribution or continuation election is required.
- Request additional leave before the existing period ends when possible.
- Provide relevant medical information and an estimated return.
- Ask for the accommodation and policy review in writing.
- Clarify pay, insurance, and return-to-work conditions.
Compare termination after FMLA runs out and medical documentation for intermittent leave. Do not assume a disability insurer’s payment approval requires the employer to hold the job indefinitely, or that FMLA exhaustion automatically permits termination without further analysis.
