SSDI benefits, including a retroactive award, can be subject to qualifying child-support enforcement under federal law. Supplemental Security Income is a different program and generally is not subject to this support-garnishment mechanism. Identify the benefit before applying the rule. [1]
The order and legal process matter
SSA acts on qualifying legal process under the governing statute and procedures. A support agency’s informal request and a valid income-withholding order are not interchangeable. Obtain the actual order and the agency’s withholding explanation.
Federal percentage limits are conditional
The Consumer Credit Protection Act establishes support-garnishment limits generally ranging from 50% to 65% of disposable earnings, depending on support of another spouse or dependent and the age of arrears. Application to the payment and any more protective state rule should be checked. [2]
For example, the largest percentage is not automatically applicable to every parent or every retroactive payment.
Separate other deductions
Approved representative fees, benefit overpayments, an LTD reimbursement demand, and child-support withholding use different authorities. A bank-account levy after deposit also raises different issues from direct SSA withholding. Review each deduction instead of assuming one percentage resolves the entire back-pay deposit.
Preserve the calculation
Keep the award notice, benefit type, covered months, fee determination, withholding order, arrears ledger, and bank records. Promptly raise an incorrect amount or mistaken identity through the appropriate agency or court.
Check the basis for the selected percentage
The support-garnishment limits distinguish whether the person supports another spouse or dependent and whether arrears exceed the specified period. Obtain the facts used for those determinations rather than assuming the highest limit applies because a large balance is owed. The disposable-earnings calculation also is not necessarily the gross amount printed on an award notice. [2]
For a retroactive payment, identify the benefit months and the legal process reaching the payment. If the award includes a representative-fee deduction or another adjustment, ask for an itemized account so different withholding authorities are not confused. The support order may still be enforceable even when a particular payment is protected. Conversely, an enforceable obligation does not permit every collection method. Raise an incorrect calculation with the responsible agency or court while preserving the applicable review deadline. [1]
See LTD repayment after SSDI and military disability and support. Different disability programs do not share identical garnishment protections.
