If your I-485 shows approved while the related I-130 still shows pending, obtain the actual decision notices before assuming the green card is invalid or the family petition is irrelevant. Online status alone cannot establish whether the discrepancy reflects a record update issue, a different case basis, or an adjudication problem. The legal question is whether the adjustment requirements were met. [1][2]
Compare the records for the same person and case
Check names, A-numbers, receipt numbers, filing categories, and approval dates. A petitioner and beneficiary can have different account views, and one family can have several petitions. Keep the complete I-485 approval notice, I-130 notices, and any issued card together when requesting clarification.
Do not submit a duplicate petition, withdraw a pending filing, or assume a later notice can be ignored merely because one screen says approved. A lawyer can help determine whether a notice refers to the same underlying immigration benefit.
Adjustment has independent legal requirements
Section 1255 generally requires an application, eligibility for an immigrant visa, admissibility, and immediate visa availability under the applicable adjustment framework. The statute contains additional categories and exceptions. An approval label does not erase the need for a legally valid basis. [1]
USCIS’s I-130 instructions separately explain that petition approval does not itself confer permanent residence. The converse is also important: different forms perform different legal functions, so confirm how the residence application was actually approved. [2]
The five-year rescission rule is not universal immunity
8 USC 1256 addresses rescission when, within five years after adjustment, the government determines the person was not actually eligible. It also states that rescission need not occur before removal proceedings and that a removal order can be sufficient to rescind status. The statute should not be summarized as guaranteeing that every immigration problem disappears after five years. [3]
The relevant dates, alleged ground, proceedings, and controlling law require individual review. A discrepancy in a case tracker alone does not establish that rescission is warranted.
Make a documented inquiry
- Preserve both forms’ notices and account records.
- Identify the adjustment basis and any outstanding request.
- Request case-specific clarification through an authorized channel.
- Respond to later substantive notices by their deadlines.
See what Form I-130 establishes and finding the correct USCIS account and receipt identifiers when organizing the inquiry.
