Can F-1 Students Work on a 1099? CPT and OPT Rules

An F-1 student can receive contractor income only when the work fits an authorized employment arrangement. A Form 1099, business registration, or client agreement does not create immigration permission. The activity, authorization category, dates, degree relationship, and actual working arrangement matter. [1]

CPT must authorize the actual training

Curricular practical training must meet the regulatory curricular requirements and receive the designated school official’s authorization. Check the employer, location, part-time or full-time designation, and authorized dates on the Form I-20 before beginning. Calling the same project consulting or unpaid training does not remove it from the employment analysis. [1]

For example, authorization for a particular curricular placement should not be assumed to cover unrelated freelance assignments accepted through a gig platform. Give the DSO the real contract and description of duties rather than only asking whether students may receive a 1099.

Ordinary OPT and STEM OPT differ

DHS has expressly explained that an F-1 student with OPT employment authorization may start and work for the student’s own business when that employment relates to the program of study. The explanation distinguishes the initial OPT period from the additional requirements governing a STEM extension. Self-employment is therefore not categorically forbidden during ordinary OPT. [3]

STEM OPT requires the qualifying employer relationship and training-plan requirements. A business arrangement that works for initial OPT may not satisfy those conditions. Review the employer’s actual supervision, training commitments, and ability to meet the regulatory obligations; a company name or tax form alone does not answer those questions. [1][3]

Check admission and authorization dates separately

The fixed-admission framework effective September 15, 2026, includes specific transition rules for qualifying students previously admitted for duration of status. Paragraph 214.1(m) also contains temporary provisions affecting certain timely post-completion OPT and STEM filings. Determine which admission and transition provisions apply instead of assuming every student remains admitted indefinitely or every legacy student needs the same filing. [4]

A tax return cannot cure unauthorized work

IRS Publication 519 determines tax treatment through rules such as tax residency, exemptions from counting certain days, income source, and applicable treaties. F-1 immigration classification does not by itself settle every tax question. Report income under the applicable tax rules even when an immigration issue also requires attention. Filing taxes does not retroactively authorize employment. [2]

Before accepting a project, document the duties, dates, degree connection, authorization, and payment arrangement. Keep contracts and work records so the employment and tax analyses can use the same accurate facts.
