Do Churches Have to Comply With the ADA?

Religious organizations and entities they control, including places of worship, are exempt from ADA Title III’s public-accommodation requirements. That exemption can extend to their religious and secular activities. It does not establish that every person or business operating at a church’s address is exempt. [1]

Rules that determine the answer

The ADA separately addresses employment. A covered religious employer can prefer members of its religion while remaining subject to applicable disability-employment requirements, with constitutional ministerial questions requiring their own analysis. State accessibility or building rules, other federal laws, and obligations attached to public funding may also matter. Analyze the actual entity and legal duty rather than the building’s name. [2]

Title III’s exemption concerns religious organizations and controlled entities, not merely organizations with religious customers or employees. An exemption also does not prevent voluntary accessibility improvements. For a concrete dispute, collect organizational documents, the lease, program-control information, and the relevant funding terms so the correct rule can be applied to the correct party. [1] [2]

What to check before taking the next step

  1. Identify who owns, operates, and controls the particular program or facility.
  2. Determine whether the concern involves public access, employment, government services, or funded programs.
  3. For an independently operated tenant, examine the tenant’s own Title III coverage and lease arrangement.
  4. Check the applicable state construction and accessibility requirements before concluding that no modifications are legally required.

Practical example

A church rents space to an independent commercial child-care business. The church’s religious exemption does not automatically exempt that separate operator’s public-accommodation activities.
