An eligible L-2 dependent in the United States can generally request H-4 classification through a change-of-status application. The principal family member must qualify for H status, and the dependent must establish the qualifying relationship and eligibility. Changing to H-4 can also change the ability to work, so coordinate the status application and any employment authorization request before making employment commitments. [1][2]
Separate status from work permission
H-4 classification does not itself authorize employment. Certain spouses of H-1B workers may apply for an employment authorization document when the principal has an approved immigrant petition or qualifying H-1B extensions under AC21. An H-4 child does not qualify under that spouse provision. Approval of the principal’s H-1B petition does not automatically approve the spouse’s work application. [2][3]
For example, a dependent who worked lawfully while in L-2 classification should not assume the same authorization continues after the effective change to H-4. Identify the legal basis and expiration of current work permission, the effective date of the status change, and whether separate H-4 employment authorization has actually been granted.
Prepare the application carefully
Form I-539 is the usual dependent change-of-status form. Assemble the current I-94, passport information, proof of the marriage or parent-child relationship, the principal’s H approval or pending petition information, and evidence supporting maintenance of the existing classification. Follow the current form instructions for signatures, dependents, filing location, and any companion filing.
A person generally must continue maintaining nonimmigrant status and file before the authorized stay expires. The regulation allows limited discretionary excuses for certain late filings, but those exceptions should not be treated as a routine extension. [1]
Fees, travel, and timing
Check the live USCIS fee schedule and filing instructions immediately before submission; online and paper eligibility, companion applications, and additional services can affect the amount and procedure. A filing receipt is not an H-4 approval or an EAD. Avoid assuming an estimated processing time guarantees a decision before existing permission ends.
Travel while a change-of-status request is pending can change the strategy and should be reviewed before departure. See H-4 employment authorization eligibility and travel during a pending employment-based immigration case for related issues. Keep copies of submissions and notices so later decisions can be compared against the requested dates.
