Appealing a Section 8 Decision: Reviews and Hearings

You can challenge many Housing Choice Voucher decisions by requesting the review or hearing described in the public housing agency’s notice. Act promptly: the local administrative plan and notice set the request procedure and deadline. There is no single federal number of days that safely covers every Section 8 dispute.

Applicant review or participant hearing?

An applicant denied admission ordinarily receives notice of the reasons and an opportunity to request an informal review. The reviewer cannot be the person who made or approved the decision, or that person’s subordinate. The applicant must be allowed to present written or oral objections. [1]

An existing participant has hearing rights for specified decisions, including certain income calculations, subsidy standards, and terminations based on family conduct or extended absence. The agency generally must offer the required hearing opportunity before ending assistance under an outstanding assistance contract. Some decisions, such as refusing a voucher extension, are excluded from the ordinary hearing requirement. [2]

Make a clear written request

Identify your name, case number, notice date, and the decision you dispute. State that you request the applicable informal review or hearing. Use the agency’s required delivery method and keep proof of timely submission. If a disability affects your ability to meet the procedure, request a reasonable accommodation and explain the connection.

Build the record around the actual reason

  • Ask for the administrative plan and records supporting the decision.
  • Collect pay records, household documents, notices, or other evidence addressing the stated issue.
  • Prepare a short timeline and identify witnesses with firsthand knowledge.
  • Explain the correction or outcome you want rather than submitting unrelated grievances.

For participant hearings, the regulation provides access to relevant agency documents and an opportunity to present evidence and question witnesses. An agency cannot rely at the hearing on relevant documents it failed to make available after a proper examination request. The hearing officer must issue a written decision. [2]

See responding to a Section 8 termination notice for termination-specific preparation. If the dispute began after earnings stopped, reporting job loss and requesting a rent adjustment may help identify the records needed. A hearing request does not automatically resolve a separate eviction case or extend its court deadline.
