Do not assume that moving out ends a Section 8 lease or preserves the voucher. The lease, state landlord-tenant law, and the public housing agency’s program rules must all be addressed. Serious lease violations can support termination of assistance even when a family intends to rent somewhere else. [1]
Start with two written notices
Tell the landlord and the PHA why you need to leave, the proposed date, and whether you seek a mutual release, an approved move, or a legally protected early termination. Ask the PHA what notice, inspection, eligibility, and moving-approval requirements apply. Keep proof of delivery.
Document the reason for leaving
Unsafe conditions should be reported and documented through the PHA’s inspection process. The voucher regulations contain housing-quality and enforcement provisions, but a defect does not automatically authorize every tenant to abandon the lease without consequences. [2]
Domestic violence protections, a disability accommodation, military orders, or a landlord’s material breach may create additional rights. Each route has its own legal requirements. Do not withhold rent or stop complying with the lease solely because a move request is pending.
Make the exit agreement specific
- Identify the final tenancy date and rent responsibility.
- Confirm whether the landlord releases early-termination claims.
- Obtain the PHA’s decision on continued assistance and moving paperwork.
- Keep photographs, key-return proof, and account statements.
For example, an agreed lease release may resolve the landlord’s claim while PHA approval is still required for the next assisted unit. Those are separate decisions.
Keep rent, possession, and assistance separate
A request to move does not by itself terminate rent liability. Continue documenting payments and required notices while the landlord and PHA decide the appropriate next steps. If the PHA proposes terminating assistance, request the written reason and applicable hearing information promptly. A move to another unit can also require new tenancy approval and inspection before assistance begins there; do not assume the old payment transfers to a new landlord automatically. For a dangerous condition, preserve dated reports and the inspection response. That record can support the actual program or tenancy remedy rather than merely explaining why the family preferred to leave. [1] [2]
Compare military-spouse lease termination under the SCRA and household changes on a Section 8 voucher before changing the lease or the assisted household.
