Divorce has different effects depending on whether permanent residence is conditional, an application remains pending, or the immigrant already has a regular ten-year green card. It does not automatically cancel every green card or end every sponsorship obligation.
Conditional residence and pending applications
A marriage-based conditional resident generally uses I-751 to remove conditions. After a final divorce, a waiver of joint filing may be available when the marriage was entered in good faith. Evidence should show the real marital relationship, not merely the divorce decree. [1]
A pending marriage-based application may lose its underlying basis when the marriage ends. An already granted ten-year status does not ordinarily disappear solely because of divorce, although fraud or other independent grounds remain relevant.
Alimony and I-864 support
State alimony rules and the federal affidavit of support are separate. An enforceable I-864 can continue after divorce until a qualifying termination event; a divorce decree alone does not necessarily extinguish that obligation. [2]
Keep the approval notices, card, petition receipt, I-864, and final family court orders. Notify counsel and the relevant agency of changes affecting a pending case. Before signing a settlement, identify both state support duties and any federal sponsorship claim so the agreement does not rest on an incorrect assumption about immigration law.
Example: a divorce before conditions are removed
A conditional resident who filed jointly and later receives a final divorce decree should not assume the original joint filing remains accurate. The applicant should determine how to request the appropriate waiver treatment and provide the final decree and evidence of good faith. A pending divorce can create different timing questions from a completed divorce. [1]
Evidence of good faith can include the couple’s shared residence, finances, insurance, children, and other reliable records of their life together. A relationship’s failure does not necessarily prove it was fraudulent. Equally, a decree stating that a marriage occurred does not by itself establish the federal good-faith requirement.
For financial support, keep I-864 documents separate from state alimony calculations. A spouse’s new job, remarriage, or a settlement provision may have different effects under each body of law. Have the actual federal termination rules reviewed before agreeing that a private release resolves all possible support duties.
A joint petition requires special attention to divorce after filing I-751. Financial duties also depend on the petitioner and sponsor roles.
