Can Urgent Care Complete FMLA Paperwork?

An urgent care doctor can complete FMLA certification if the provider meets the regulatory definition and has enough medical information to support the requested leave. A clinic’s urgent care label does not disqualify a licensed doctor of medicine or osteopathy authorized to practice within the applicable jurisdiction. [1]

The provider and condition both must qualify

Section 825.125 also recognizes specified other providers, subject to their stated licensing and scope-of-practice conditions. Verify the actual clinician’s credentials rather than assuming every person working at a clinic qualifies. [1]

The illness must independently meet the serious-health-condition rules. Section 825.115 addresses continuing-treatment categories, including qualifying incapacity and treatment, chronic conditions, and other listed circumstances. A brief routine visit alone does not establish protected leave. The relevant treatment, incapacity, and expected duration must support the particular category. [2]

Bring the information the clinician needs

Take the employer’s certification request, a description of essential job duties, relevant medical history, and the planned follow-up. An urgent care clinician may have enough information about an acute episode but lack a basis for estimating months of intermittent absences. Ask whether a continuing provider should address that longer pattern.

A useful certification connects medical facts with the leave needed. A generic return-to-work note may not provide the information requested for continuous or intermittent FMLA leave. Keep a copy of what the clinician actually submits rather than assuming a signed page is complete. [3]

The ordinary 15-day response and 7-day cure rules

Under 825.305(b), an employee ordinarily must return requested certification within fifteen calendar days. Exceptions include impracticability despite diligent, good-faith efforts and an employer allowing more time. Tell the employer promptly about a documented difficulty instead of silently missing the deadline. [3]

If a submitted certification is incomplete or insufficient, the employer must identify the necessary additional information in writing and normally allow seven calendar days to cure it. The regulation again qualifies the deadline when compliance is impracticable despite diligent, good-faith efforts. A certification never returned is treated differently from one submitted with deficiencies. [3]

Respond to the actual deficiency

For example, if the missing item is the likely frequency of medically necessary episodes, ask the appropriate treating provider to address that issue. Do not substitute unrelated records or request unlimited absences without medical support. Save the request, submission confirmation, deficiency notice, and response.

The clinician supplies medical certification; signing it does not by itself establish every employee-eligibility or leave-designation requirement. The employer is responsible for designation under 825.301. Match the paperwork to the actual absence and the employer’s stated process. [4]
