Can You File I-130, I-485, and I-765 Together?

You may file Forms I-130, I-485, and I-765 together when the immigrant category permits concurrent filing and you independently qualify to adjust status. The forms perform different jobs: I-130 establishes a qualifying family relationship, I-485 requests permanent residence, and I-765 requests employment authorization.

Visa availability is only one requirement

Immediate relatives of U.S. citizens ordinarily have visa numbers available without a preference-category waiting line. Preference applicants must check the applicable Visa Bulletin and the chart USCIS authorizes for adjustment filings that month. An approved or pending I-130 does not eliminate the visa-number requirement. [1]

You must also examine entry, admissibility, status history, employment history, and any adjustment bars or exceptions. Marriage to a citizen does not automatically cure every immigration issue. A prior removal order or entry without inspection requires particular care before submitting a package.

Build a coordinated package

Use the current instructions for every form, confirm that your filing category accepts the proposed filing method, and identify the correct address. Include the relationship evidence, entry records, sponsorship documents, required medical evidence, identity documents, photographs, and other materials applicable to your case. [2]

Check current fees separately for each form and any available exemption or reduction. Do not rely on an older instruction that the work permit is always free with adjustment. A single combined payment may create avoidable rejection problems where separate payments are required.

Filing is not immediate work permission

A receipt for I-485 or I-765 generally does not itself authorize employment. The pending-adjustment employment category requires the relevant authorization unless another independent basis already allows the work. [3]

For example, a visitor who submits all three forms should not begin a job merely because the package arrived at USCIS. Someone with independently valid work authorization must still observe its conditions and expiration rules.

Read what a pending I-485 means for remaining in the United States and I-485 filing methods and package preparation before sending the forms. Travel requires its own analysis; an adjustment application is not automatically a reentry document.
