An eligible employee can use FMLA for a personal serious health condition and later to care for a qualifying family member. For ordinary FMLA reasons, those absences generally draw from the same 12-workweek entitlement in the employer’s applicable 12-month period. A second medical reason does not create a second bank. [1]
Check the employer’s leave year
Employers may use permitted calendar, fixed-year, forward-measured, or rolling methods under the regulations. The method determines whether earlier leave still counts. Ask for the leave balance and the method in writing rather than estimating from the calendar. [1]
Each absence must qualify
The employee must satisfy applicable eligibility requirements and establish the qualifying reason. Care for a spouse, child, or parent with a serious health condition can qualify; the FMLA definitions and age or disability rules for children matter. A separate certification may be appropriate for each condition. [2]
Intermittent leave may be available when medically necessary. The employer can count the actual qualifying leave used under the applicable rules rather than automatically charging every week in which an appointment occurs.
A simple balance example
If an employee properly used four weeks for surgery and has no other relevant leave, the ordinary balance may be eight weeks for qualifying care of a parent in the same leave period. Military-caregiver leave has a special entitlement and should be calculated separately.
Spouses working for the same employer have special combined limits for certain reasons, not a universal combined limit for every personal or family illness.
Convert intermittent time using the actual schedule
Twelve workweeks is not always the same number of calendar days or hours for every employee. A part-time or variable schedule requires the applicable regulatory calculation. An occasional appointment, a reduced schedule, and a continuous absence should be recorded accurately rather than charging a full week merely because some leave occurred. Ask for corrections when the employer’s ledger does not match the qualifying time used. [1]
For a new family-care request, provide the information needed to establish that reason even when the employer already approved personal medical leave. The earlier certification may not explain why the employee needs to care for another person. Also confirm whether a calendar boundary truly creates new entitlement under the employer’s selected method; it does not do so under every permitted method.
