Can You Stay in the U.S. While an I-130 Is Pending?

A pending I-130 does not, by itself, give you legal status, work permission, or a right to remain in the United States. It is a petition establishing a qualifying family relationship. Whether you can stay depends on an independent lawful basis or a properly available immigration process.

The petition and residence application are different

Section 1154 governs family and other immigrant-petition procedures. Approval can establish the relationship and category, but it is not the same decision as granting permanent residence. A family preference case can also wait for visa availability after petition approval. [1]

For example, a visitor’s authorized stay does not automatically extend because a spouse files an I-130. A person abroad also does not receive permission to enter simply because the petition is pending.

Adjustment may provide a separate route

A qualifying applicant in the United States may be able to file I-485 when visa availability, entry, admissibility, and other requirements are met. The adjustment statute contains bars and exceptions, including different treatment for certain immediate relatives. Marriage does not cure every entry or inadmissibility problem. [2]

A properly pending I-485 has consequences different from an I-130 alone, but still does not automatically authorize work or unrestricted foreign travel.

Do not assume an overstay is harmless

Failing to maintain status can affect future applications. Unlawful presence and departure can create additional issues under their own rules. A prospective family-based benefit is not a reason to ignore an expiring admission or existing removal order.

  • Check the I-94 and any status extension or change decision.
  • Identify the petitioner’s status and immigrant category.
  • Confirm current visa availability where required.
  • Assess adjustment eligibility before the present stay expires.
  • Review departure consequences before choosing consular processing.

Compare concurrent I-130 and I-485 filing and remaining while adjustment is pending. If a case is at NVC, document completion and visa waits explains the separate consular stage. Avoid filing an ineligible application solely to obtain a receipt; acceptance for processing is not a legal finding that every requirement is satisfied.
