FMLA and Short-Term Disability: Concurrent Leave Rules

FMLA and short-term disability can run at the same time when an eligible employee’s absence qualifies under FMLA and the benefit plan. FMLA generally provides protected leave, while short-term disability provides payments under separate plan terms. Approval for one does not automatically establish eligibility for the other. [1] [2]

Why the periods can overlap

A qualifying serious health condition can support FMLA leave while also meeting a disability plan’s definition. The employer must apply the FMLA notice and designation rules; the employee cannot assume the statutory clock waits until the disability checks end. [1] [2]

The payment plan may have a waiting period or different effective dates. An absence can therefore count as FMLA even before disability payments begin. Conversely, receiving disability payments does not guarantee that federal FMLA eligibility or a remaining leave balance exists.

Paid leave supplementation has its own rule

The FMLA regulation distinguishes substitution of accrued paid leave from periods covered by disability benefits. Because that benefit period is not unpaid leave in the same sense, the ordinary substitution mechanism does not apply identically. The parties may agree to supplement the benefit where the applicable rules permit it. [1]

Review the plan and employer policy instead of assume that all accrued vacation must be used or that no supplementation is possible. Ask payroll to explain the source of each payment and how it affects available balances.

Obtain a written timeline

Keep the eligibility notice, designation, certification, benefit decision, expected absence dates, and return-to-work requirements. The employer’s FMLA communications and the insurer’s benefit communications should be reviewed separately. A medical update requested by one does not necessarily satisfy the other. [2]

For example, an employee may exhaust FMLA before the benefit plan stops payments. Continued income replacement does not automatically extend FMLA job restoration. Other leave or disability-accommodation rights may need a separate assessment. Likewise, a benefit denial does not itself prove the absence fails FMLA. Ask which standard was not met and address that decision. A useful leave calendar shows the protected-leave period, payment period, waiting days, and any approved supplemental pay without treating them as one interchangeable entitlement. [1] [2]
