FX2 is an immigrant visa classification for an eligible child of a lawful permanent resident. It belongs to the F2A family preference category and identifies visas issued from the portion exempt from per-country limits. It does not eliminate the annual worldwide limit or create a faster application that a family can separately request. [1]
Who can qualify?
The beneficiary generally must be unmarried and qualify as a child under immigration law, ordinarily meaning under 21. The petitioner must establish permanent residence and a qualifying parent-child relationship. Biological, stepchild, and adoption cases have different legal requirements; a birth certificate alone does not resolve every relationship question.
Turning 21 does not necessarily end F2A eligibility. The Child Status Protection Act may preserve a qualifying age, depending on petition pendency, visa availability, and timely steps to acquire residence. Marriage presents a different problem because permanent residents cannot petition for married sons or daughters. [2]
How the case moves
- The parent files Form I-130 with evidence of status and relationship.
- After approval, an overseas case ordinarily moves to the National Visa Center for fees, the DS-260, financial sponsorship, and civil records.
- The applicant waits for visa availability and an interview appointment, then completes the required medical examination and consular interview.
A beneficiary already in the United States may have an adjustment route, but being physically present does not establish eligibility. Review when family petitions and adjustment applications can be filed together before choosing that process.
What determines the wait?
The meaningful dates are the I-130 priority date, the documentarily complete date, and the current Visa Bulletin cutoff for the relevant category and chargeability. The FX exemption should not be read as a promise that a visa number is available. An approved petition establishes the relationship; it is not permission to immigrate immediately.
For example, a child can finish NVC documents while a priority date remains unavailable. That case may still wait even when the embassy has appointments. See why a documentarily qualified case can remain at NVC. Keep contact information current, retain every notice, and obtain an age-protection review before assuming that a birthday changes the category.
