How Long Does a QDRO Payment Take After Divorce?

There is no universal federal deadline requiring every QDRO payment within thirty, sixty, or ninety days. Timing depends on whether the order is qualified, the retirement plan’s terms, the benefit type, and when a distribution is legally available. A signed divorce order is only one stage. [1]

Rules that determine the answer

The plan administrator reviews whether the domestic relations order meets ERISA’s qualification requirements. Defined-contribution plans may offer an account distribution after qualification; defined-benefit pensions may pay under retirement and commencement rules. A QDRO cannot require a benefit form or amount the plan does not provide. [1] [2]

An alternate payee should confirm whether payment will be direct, rolled over, or delayed by plan rules. Tax withholding, any rollover eligibility, loans, and valuation-date adjustments can change the net amount received.

What to check before taking the next step

  1. Ask the plan for its QDRO procedures and a written status of the qualification and distribution review.
  2. Collect the filed order, qualification notice, plan terms, distribution election, and tax instructions.

The plan must determine qualified status within a reasonable period and notify affected parties. The familiar eighteen-month period concerns segregation of amounts potentially payable to an alternate payee; it is not permission to take eighteen months for every qualification review and is not a universal payment deadline. Ask which stage is pending: correcting the order, qualifying it, selecting a distribution, processing a rollover, or commencing pension payments. Each has different documents and dependencies. [2]

Practical example

A former spouse receives a signed order in March, but the plan requests a corrected identifying provision in April. The payment timetable cannot reliably be measured only from the divorce date.
