Requesting a Stay of Removal: Which Filing Matters?

A stay temporarily prevents execution of a removal order; it does not cancel the order or grant immigration status. Start by identifying whether an automatic stay applies and which agency or court currently has authority over the case. [1]

Check automatic protection first

The regulations generally restrict execution while a timely appeal from an immigration judge’s removal decision is pending before the BIA, subject to exceptions. A motion to reopen or reconsider ordinarily does not itself stay removal. In absentia rescission motions have a specific statutory protection discussed in reopening an in absentia order. [1]

Request the right discretionary stay

Depending on posture, a request may go to the immigration judge, BIA, ICE, or a federal court reviewing an order. An ICE administrative stay and an EOIR stay are different procedures. Filing one does not automatically establish protection under the other.

A supported request should identify the order, procedural history, pending relief, imminent removal risk, legal basis, and evidence of harm. Include proposed relief, service information, and the documents required by the deciding body.

Do not confuse filing with approval

For a BIA appeal, verify the filing deadline and actual receipt requirements. EOIR generally uses a 30-day deadline for appeals of immigration-judge decisions, with limited rules concerning equitable tolling. Mailing near the deadline may not suffice. [2]

If removal is imminent, use the decision-maker’s current emergency procedure and confirm whether an actual stay order has issued. Keep a copy accessible to counsel and relevant officials. A submission receipt is not a granted stay.

Describe urgency with evidence

A discretionary request should explain what event makes removal imminent and why ordinary review would be inadequate. Attach the relevant order, scheduled reporting or travel information where available, and evidence supporting the claimed harm and legal position. If seeking an emergency decision, follow the deciding body’s current filing and contact procedure and confirm the request reached the correct office. A lawyer’s statement that a motion was sent is not equivalent to an order granting protection. Keep the stay’s scope and expiration visible: a stay can pause execution while leaving detention, reporting, or other obligations unchanged. [1]

For example, filing a routine reopening motion on Friday does not itself prohibit removal on Monday. Review motion-to-reopen rules and the particular automatic-stay exception before relying on a filing.
