An H-4 spouse’s status depends on the qualifying marriage. A final divorce generally ends that basis for H-4 eligibility even when a visa stamp or admission document shows a later expiration date. [1]
Separate divorce from physical separation
Living apart does not necessarily end a legal marriage. A final divorce decree does. Immigration consequences therefore turn on the actual legal event and any independently approved status, not merely the date spouses stopped sharing a home. [1]
A work permit based on being an eligible H-4 spouse cannot be treated as an independent immigration status. Determine whether another basis authorizes employment before continuing work after eligibility changes. [1]
Review options before the decree becomes final
Collect the current I-94, H-4 approval, work permit, divorce filings, and any separate immigration applications. Assess eligibility for a different classification or departure with qualified advice. A pending application does not automatically cure a status violation. [1]
Do not assume that the discretionary grace period connected to a principal worker’s job loss supplies a divorce grace period. Those are different circumstances governed by different requirements. [1]
Practical application
A spouse with a pending change-of-status application should check how divorce affects both the existing classification and the pending request. A filing receipt can prove that paperwork was submitted without establishing continuing H-4 eligibility. If children also hold derivative status, analyze their eligibility separately rather than assuming the parents’ divorce has an identical effect on every family member’s classification. [1]
A visa stamp is not continuing derivative eligibility
A visa can remain printed in a passport after the relationship needed for the classification ends. That does not mean the holder can use it as though still eligible for H-4 admission. Likewise, an employment card based on the spouse relationship must be considered with the eligibility conditions that supported it. A change-of-status request requires its own timely and legally sufficient basis. Before travel or another filing, review the final divorce date, current admission record, pending applications, and any separate classification rather than relying on one document’s future date.
