Why Is There a HUD Lien on Your House?

A HUD lien may secure an FHA partial claim or another federal housing obligation. The recorded instrument and loan program determine when repayment is required. [2]

Identify the recorded debt

A partial claim can move eligible mortgage arrears into a separate, interest-free subordinate lien. It does not require ordinary monthly repayment, but it remains a debt with repayment triggers identified by the program and note. Paying the first mortgage on schedule therefore does not by itself establish that the separate partial-claim balance has been satisfied. [1][2]

Obtain the recorded mortgage or deed of trust, note, servicing history, and any loss-mitigation agreement. [2]

Before selling or refinancing

Ask the responsible servicer or HUD-designated contact for a written payoff and release procedure. Confirm whether the lien secures a current balance or should already have been satisfied. [2]

A county recorder records documents but does not usually decide the federal payoff balance. Do not pay an unsolicited caller merely because a public lien record exists. [2]

Practical application

A title report may reveal a subordinate HUD lien even though the homeowner has been paying the main mortgage on schedule. That can reflect an earlier loss-mitigation arrangement rather than a new missed payment. Locate the original agreement and ask for the correct payoff. Before closing a sale, confirm who will issue the release and how it will be recorded. [2]

Ask what event triggers repayment

The note and program documents determine whether repayment is triggered by a sale, refinance, payoff of the first mortgage, transfer, or another specified event. A deferred obligation can remain secured even when it requires no regular monthly payment. That explains why a homeowner can be current on the primary loan and still need a separate payoff at closing. Request a breakdown of principal and any other permitted amounts and verify the payment destination through a trusted servicing channel. If the debt was previously paid, provide the satisfaction evidence and ask for correction of the recorded lien. [1] [2]

A closing agent should receive the payoff from the responsible creditor or authorized servicer, with instructions identifying the recorded obligation that will be released. [1]
